1. Introduction

Welcome to Q Wellness.

Q Wellness is a digital marketplace product of Octopus Ventures.

These Terms of Service govern access to and use of the Q Wellness website, applications, professional listings, booking facilities, communications and related services.

By accessing or using Q Wellness, you agree to these Terms.

If you do not agree, please discontinue use of the platform.

2. Marketplace Role

Q Wellness provides technology connecting customers with independent wellness professionals.

Q Wellness does not itself deliver the professional services listed on the marketplace.

Professionals are independent service providers and are responsible for the services they advertise and deliver.

Unless expressly stated otherwise, no employment, agency, partnership or clinical relationship exists between Q Wellness and listed professionals.

Q Wellness does not guarantee the suitability, quality, safety or outcome of an individual service.

Nothing in these Terms excludes responsibilities or legal rights which cannot lawfully be excluded.

3. Eligibility

Users must be at least 18 years old to create an account or make a booking unless Q Wellness expressly introduces an approved arrangement for minors.

Users must provide accurate registration information and maintain the security of their accounts.

4. Professional Listings

Professional profiles may include qualifications, certifications, experience, services, pricing, location and availability.

Professionals are responsible for the accuracy of their submitted information.

Verification indicates completion of Q Wellness's applicable review process. It does not constitute a guarantee of competence, safety, professional licensing in every location or service outcomes.

5. Bookings

Customers select services and appointment times through the platform.

A booking becomes confirmed only when the required booking and payment conditions have been satisfied.

Booking confirmations will contain the relevant session information.

Professionals must deliver sessions according to their confirmed booking details.

6. Payments

Customers agree to pay the displayed booking amount and any clearly disclosed applicable charges before confirming a paid booking.

Payments are processed through supported payment service providers.

Q Wellness facilitates payment collection and commission accounting according to the applicable professional agreement.

7. Cancellations and Refunds

Bookings are subject to the published Booking and Cancellation Policy and Refund Policy.

Any service-specific conditions must be displayed before checkout.

Mandatory consumer rights take precedence where applicable.

8. Physical Wellness Services

Fitness, yoga, movement, breathwork and related physical activities involve potential physical risks.

Customers are responsible for providing accurate information relevant to their participation and for selecting activities suitable for their circumstances.

Customers should seek qualified medical advice before participating when they have a relevant medical concern.

Professionals are responsible for providing appropriate instructions and operating within their professional competence.

9. Nutrition and Lifestyle Services

General nutrition and lifestyle coaching is intended for education and personal wellbeing.

It does not replace medical diagnosis, prescribed treatment or individualized clinical care.

Professionals must not provide regulated healthcare services without appropriate authorization.

10. Spiritual and Holistic Services

Spiritual, energetic, intuitive, meditation and other holistic services may involve personal beliefs, subjective experiences or traditions which do not have established scientific evidence of effectiveness.

Q Wellness does not guarantee spiritual, emotional, financial, relationship or health-related outcomes.

These services must not be represented as substitutes for medical, psychological, legal or financial advice.

11. Professional Independence

Customers understand that professionals determine and deliver their own services.

A professional's views, teachings, beliefs or methods do not necessarily represent those of Q Wellness or Octopus Ventures.

12. Prohibited Activities

Users and professionals must not engage in fraud, harassment, discrimination, exploitation, misleading advertising, unauthorized medical practice, unsafe conduct or unlawful activity.

Professionals must not make guaranteed cure claims or pressure customers into additional purchases.

13. Reviews and User Content

Reviews must reflect genuine experiences.

Q Wellness may moderate content that is fraudulent, abusive, discriminatory, misleading or otherwise violates platform policies.

Users retain ownership of their original content but grant Q Wellness permission to display submitted public reviews and profile content for marketplace operation and promotion, subject to applicable privacy rights.

14. Account Suspension

Q Wellness may restrict or suspend accounts where reasonably necessary to investigate suspected fraud, safety concerns, policy violations or misuse.

15. Platform Availability

Q Wellness aims to maintain reliable platform access but does not guarantee uninterrupted service.

Maintenance, third-party failures and technical issues may affect availability.

16. Intellectual Property

Q Wellness branding, software, platform design, original content and related intellectual property belong to their respective owners or licensors.

Users must not copy, redistribute or commercially exploit protected platform materials without permission.

17. Liability

Q Wellness is responsible for its own marketplace operations to the extent required by applicable law.

Independent professionals remain responsible for their own services, conduct and professional obligations.

Q Wellness does not guarantee specific wellness outcomes.

Any limitations of liability apply only to the extent permitted by applicable law and do not exclude liability which cannot lawfully be excluded.

Q Wellness may update these Terms.

Material changes will be communicated where appropriate.

The effective date will be updated when changes take effect.
